Public Liability

A State, County or Cities is responsible to design and maintain their property in a safe condition. Sadly, many of our highways and roadways are not safe and do not comply with even minimal safety standards. The same goes for schools, and other government buildings. The sad result is that many people die or suffer serious and catastrophic injury due to these unsafe conditions. For example, a highway design may be outdated and not intended for modern traffic volumes; guardrails my be substandard or missing altogether; dangerous slope may be unprotected or other less obvious defects may exist – only to be discovered by high traffic accident history found during an investigation.

20% of all fatal road accidents involve a single car that runs off the road, often rolling over or colliding with a fixed object. While government defendants often argue that such accidents result from driver error, dangerous roads may be all or part of the cause of the accident.

Dangerous road cases are difficult and expensive. The government bodies controlling the roads have strong defenses put in place by the government itself. Therefore, proving that a dangerous road caused an accident can be a challenge. Investigation of the dangerous road site and its history requires substantial attorney work, expense, and expertise. But successful cases not only benefit the client: they directly force changes in dangerous road conditions that can save lives - changes that might not otherwise occur at all.

In regards to public schools, the school has statutory duties to protect your children from dangerous property, people or activities.

DeWitt . Algorri . Algorri has settled or tried to verdict many such cases against many school districts, Cal Trans and many counties and numerous cities, and is ready, willing and able to commit the necessary resources to win the case.
